STEP 2 - Terms of ServicePlease review and accept our Terms of Service by clicking this button and completing the form: OPEN FORM Terms of Service WORK * Designer does not begin work until the below terms of service and the service agreement have been met, regardless of project deadline. “Work” is defined as any digital, verbal, or physical action by the Designer that leads to the fulfillment of services as described in the service agreement. AGREE ASSETS * Client will send Designer all available/possible assets including but not limited to: graphics, photos, text/copy, pricing structures, product description text, and product variant breakdowns based on the nature of the Client’s product. AGREE CREDENTIALS * Client will add all applicable login credentials into the “Credentials” Google Doc located in the Google Drive (see button above), for any social media platforms they wish to have integrated into their new website. AGREE PRODUCT COSTS * With guidance and advice from Designer, Client is financially responsible for all applicable hosting costs, domain purchase/registration costs, Squarespace 7.1 account purchase, and any third-party software costs such as plugin-in’s, scheduling software, and/or any other digital product the Client wishes to have integrated into their website - these costs are in addition to Designer’s flat fee. These purchases will be done together to take advantage of any Designer discounts available. AGREE FINAL AGREEMENT * These terms of service are made in Los Angeles, California and will be construed according to California law. Any modification to the terms of this agreement shall only be enforceable if agreed upon in writing between Jonathan Morgan of DominantArts.Design and any/all entities involved. Any violation of this agreement may result in termination of the project and/or legal action as deemed appropriate by Designer and Designer's legal counsel. OPEN FORM Service Agreement ENGAGEMENT * Designer agrees to provide services for the creation of a new website that will provide a robust online presence for the Client. AGREE SERVICES * Designer will provide the following services: I. 8 hours website creation/design (includes integration of any third-party software as needed) via Squarespace 7.1. This is the time it takes Designer to build the structure of the new website. II. 8 hours website ecommerce page(s) creation. This is the time it takes Designer to create all store pages and build all ecommerce functionalities. III. 2 hours branding consistent with website design. This is the time it takes Designer to create basic branding for the site (logo, favicon, and drop emblem graphics). IV. 2 hours editorial adjustments to content consistent with the artistic and professional online narrative as created and discussed between Client and Designer, leading up to and including the launch of the Client’s website. The launch of a website is defined as the moment the site goes live and includes the following 2 weeks after the site becomes live. V. 2 hours SEO sweep/adjustment. This is the time it takes Designer to adjust all elements needed for a strong SEO strategy: site descriptions, page titles, custom URLs, search-friendly formatting, and other key elements. Each site also generates a sitemap automatically that helps Google crawl, understand, and rank a website. Designer will create and install a Google Search Console integration and upload an .xml sitemap to Google, ensuring the new website is correctly indexed by Google. VI. Complimentary 2 hour portrait shoot that includes up to 8 final/edited images optimized for the new website. VII. Regular communication via email, phone/video chat, and Google Drive comments regarding artistic/design choices, advice, and best practices. AGREE INVESTMENT * Client agrees to pay Designer a flat fee, the total gross sum of $2200 USD (plus any applicable processing fees). This flat fee reflects 22 hours of Designer's dedicated time to this project, and is full payment for services rendered as described above. Any/all payments of the flat fee are final. With guidance and advice from Designer, Client is also financially responsible for hosting costs, domain purchase/registration costs, Squarespace 7.1 plan purchase, and any third-party software costs such as plugins, scheduling software, and/or any other digital product the Client wishes to have integrated into their website - these are purchases that we should do together because of Designer discounts that can be applied at purchase. These purchases are in addition to Designer’s flat fee. At least one installment of the flat fee must be paid prior to Designer beginning work on any/all services as outlined above. Client is welcome to pay the flat fee in any form of installments they wish, however the entire flat fee must be paid in full prior to launching the new website, regardless of project deadline. Payment may be made using the below methods - please select your preference and if applicable, briefly describe your proposed payment installment schedule. If you select the payment plan option, your private cart will be adjusted to reflect your installment schedule. AGREE PROPOSED PAYMENT PLAN * in full installments PROPOSED PAYMENT METHOD * Please select your payment method PayPal Venmo Credit / Debit / Bank Card Zelle GooglePay Credit Card, PayPal, and Venmo transactions will incur an additional 2.9% + ¢0.30 processing fee, for which the Client is responsible. COMPLETE AGREEMENT * This contract constitutes the entire agreement between Client and Designer. Parties agree that any modification to the terms of this contract shall only be enforceable if agreed upon in writing between the parties. This Agreement is made in Los Angeles, California and will be construed according to California law. AGREE FORCE MAJEURE * This agreement is subject to cancellation without penalty on either side in case of war or civil disobedience, or any other force majeure makes it necessary. Any violation of this agreement may result in termination of the project and/or legal action as deemed appropriate by Designer and Designer's legal counsel.
